1. Acceptance of Terms

By accessing or using Tinytalk (the "Service"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree, do not use the Service. These Terms apply to all users, including individuals and organizations that register an account or invite team members.

2. Description of Service

Tinytalk is a social media management platform that provides:

• A unified inbox that consolidates messages and comments from Facebook Pages and Instagram accounts.
• AI-powered automatic replies trained on your knowledge base to respond to customer queries on your behalf.
• A knowledge base builder that lets you upload PDFs and link websites to train the AI.
• AI-assisted post creation including AI-generated images and copy for your social channels.
• Analytics and insights on your connected Facebook Pages and Instagram accounts.
• Team collaboration allowing you to invite unlimited users to your organization workspace.

The Service is provided free of charge. We reserve the right to introduce paid features, plans, or limits in the future with reasonable notice.

3. Accounts and Registration

You must create an account to use the Service. You agree to:

• Provide accurate, current, and complete registration information.
• Keep your password secure and not share it with others.
• Notify us immediately of any unauthorized access to your account.
• Be responsible for all activity that occurs under your account.

You must be at least 16 years old to create an account. Accounts created on behalf of an organization bind that organization to these Terms.

4. Team and Organization Use

You may invite unlimited users to your organization workspace. By inviting users, you represent that you have authority to bind them to these Terms on behalf of your organization. You are responsible for managing access and revoking permissions when users leave your organization. Each invited user must accept these Terms.

5. Third-Party Integrations (Meta)

Tinytalk integrates with Facebook and Instagram (Meta) using official APIs. By connecting your accounts, you:

• Authorize Tinytalk to access and manage messages, comments, and insights on the connected pages and accounts.
• Agree that your use of Meta data through our platform is subject to Meta's Platform Terms.
• Remain solely responsible for ensuring that AI-generated replies sent through the Service comply with Meta's policies and your applicable laws.
• Understand that Tinytalk is not affiliated with or endorsed by Meta.

6. AI Features and Knowledge Base

Our AI features generate automatic replies and content based on the knowledge base you build. You acknowledge and agree that:

• You are responsible for the accuracy, legality, and appropriateness of all content you upload to the knowledge base (including PDFs and website data).
• AI-generated replies and posts may occasionally be inaccurate, incomplete, or inappropriate. You are solely responsible for reviewing, enabling, and monitoring AI-generated content sent from your accounts.
• You will not use AI features to generate misleading, harmful, defamatory, or illegal content.
• We do not guarantee any specific outcome from AI-generated replies or posts.

7. Acceptable Use

You agree not to use the Service to:

• Violate any applicable law or regulation.
• Send spam, unsolicited messages, or harassing content.
• Infringe the intellectual property rights of others.
• Upload malicious code, viruses, or harmful content.
• Attempt to gain unauthorized access to our systems or other users' accounts.
• Resell, sublicense, or commercially exploit the Service without our written consent.
• Interfere with or disrupt the integrity or performance of the Service.

We reserve the right to suspend or terminate accounts that violate these restrictions.

8. Your Content and Ownership

You retain ownership of the content you upload or create through the Service (knowledge base documents, posts, etc.). By using the Service, you grant Tinytalk a limited, non-exclusive license to process and use your content solely to provide the features you have enabled (e.g., AI training, message display, analytics). We do not use your content to train general-purpose AI models or share it with third parties for their own purposes.

9. Data Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to the collection and use of your information as described there.

10. Intellectual Property

The Tinytalk name, logo, website, and platform (excluding your content) are owned by or licensed to us. You may not copy, modify, distribute, or create derivative works from any part of our platform without written permission. All rights not expressly granted are reserved.

11. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be error-free, uninterrupted, or that AI-generated content will be accurate or complete. Use of the Service is at your own risk.

12. Limitation of Liability

To the maximum extent permitted by applicable law, Tinytalk and its team shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, data loss, or reputational damage arising from your use of or inability to use the Service—even if we have been advised of the possibility of such damages.

13. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access immediately, with or without notice, if we believe you have violated these Terms or if required by law. Upon termination, your right to use the Service ends and we may delete your data in accordance with our Privacy Policy.

14. Changes to These Terms

We may update these Terms from time to time. The revised version will be posted on this page with an updated "Last updated" date. Continued use of the Service after changes take effect constitutes your acceptance. For material changes, we will make reasonable efforts to notify you in advance.

15. Governing Law

These Terms are governed by the laws of the jurisdiction in which Tinytalk operates, without regard to conflict of law principles. Any disputes shall be resolved in the courts of that jurisdiction.
